Can you work for a foreign company from South Africa?

Yes: a company abroad can pay you as an independent contractor, employ you through an employer of record, or hire you through its own entity in South Africa. What changes between the three is who handles tax, what protections you get and how the money arrives.

What the law in South Africa says about income from abroad

  • South Africa taxes its tax residents on worldwide income, while non-residents are taxed only on income from a South African source. Source 1
  • SARS defines any person who receives income other than remuneration, such as invoiced fees, as a provisional taxpayer. Source 2
  • A natural person who earns remuneration from an employer that is not registered for employees' tax is also a provisional taxpayer under the Fourth Schedule to the Income Tax Act. Source 2
  • The foreign employment income exemption covers an employee's pay for services rendered outside South Africa, and applies only after more than 183 full days abroad in a 12-month period. Source 1
  • SARS states that income received by independent contractors falls outside section 10(1)(o)(ii), because it is not treated as remuneration. Source 1

Five questions to ask before you sign

  1. Am I a contractor or an employee, and under which country's law is the contract?
  2. In what currency am I paid, and who sets the exchange rate?
  3. Through which channel does the money arrive, and who pays the fees?
  4. If an employer of record employs me, which one, and will I get a payslip from South Africa?
  5. Will anyone ask me to pay for equipment or training? (If yes, walk away.)
